Nearly every residential tenancy in Bangalore is written for eleven months. Tenants often assume it is a landlord's trick to make eviction easier. It is not — the reason is a single provision in registration law, and understanding it tells you exactly what your agreement does and does not do.
Why eleven and not twelve
Under the Registration Act, a lease of immovable property from year to year, or for a term exceeding one year, must be compulsorily registered at the sub-registrar's office. A term of eleven months falls below that threshold, so it escapes compulsory registration.
Registration means a trip to the sub-registrar, appointments, registration fees and stamp duty calculated on a different and higher basis. Eleven months avoids all of it. That is the entire explanation — there is nothing more sinister to it, and it is equally convenient for tenants.
Is an unregistered eleven-month agreement legally valid?
Yes, for the purposes people normally need it: proving your address, opening a bank account, school admission, police tenant verification, gas connection, HRA claims. It is a valid contract between the parties.
Be clear about the limit though. An unregistered document has weaker standing as evidence in a property dispute than a registered one. If you are entering a long, high-value or commercial tenancy where you genuinely expect to have to enforce the terms, registration is worth the trouble. For an ordinary flat, eleven months unregistered is the normal and sensible choice.
Registration and notarisation are not the same thing
People use these interchangeably and they are completely different.
- Registration is a government act at the sub-registrar's office. It puts the document on the public record.
- Notarisation is a notary attesting the signatures. It does not register anything.
An eleven-month agreement legally requires neither. But banks, schools and passport offices frequently ask for a notarised copy as a matter of their own policy, so most people take it. Notarisation starts from ₹200. Ask the institution what they want before paying for something you may not need.
What happens after eleven months
The agreement simply ends. There is no automatic rollover. In practice landlord and tenant either sign a fresh agreement or carry on informally — and carrying on informally is a bad idea, because the moment you need to prove your address you have nothing current to show.
A renewal is a new agreement on a new e-stamp certificate. It is not an extension of the old one and it is not free. Many people also use renewal as the moment to revise rent, which is why an escalation clause in the original saves an argument.
Can it be ended early?
Only in line with what the agreement says. This is why the notice period clause matters more than most people realise at signing. One month and two months are both common in Bangalore. If there is a lock-in period, leaving before it ends usually means forfeiting part of the deposit — read that clause specifically.
Rent escalation
Because the term is short, escalation clauses are less common than in long leases, but they do appear where the parties expect to renew. If you want one, tell us at drafting — it is a sentence, and adding it later means a new agreement.
What eleven months does not protect you from
- Deposit disputes. The most common conflict by far, and the agreement only helps if the deposit amount and refund terms are written clearly.
- Undocumented condition of the property. Photograph the flat at handover. The agreement does not do this for you.
- Verbal promises. A promise about painting, parking or repairs that is not in the document did not happen.
